Company
Key2 Plastics Ltd trade exclusively under the following terms and conditions. These may only be waived with the written consent of a director of the company and supersede and replace any other contractual terms not withstanding the right of individuals and companies under English Law. The company shall mean Key2 Plastics Ltd.
Liability:
If any goods or services supplied by the company should prove on inspection to be defective in material or workmanship, the company undertakes as its option to replace or refund to the buyer the price of the goods, but in no circumstances will liability exceed the replacement cost of the goods or the price paid by the buyer for the goods.
The company shall not be liable for damages, whether negligible or otherwise, however caused or occasioned (except death or personal injuries resulting directly from the company negligence) and this undertaking is given in place of and excludes all other warranties and conditions whatsoever whether expressed or implied by statute or common law in so far as and to the extent that it is lawful to exclude them.
The buyer shall determine the suitability of the products, design and services offered for his intended use and shall not rely upon any representation made by the company, nor anyone acting on its behalf. In no circumstances will the company’s liability exceed the limitations set forth above.
Retention of Title:
The risk in the goods shall pass from the seller to the buyer upon delivery of such goods to the buyer. However, notwithstanding delivery and the passing of risk in the goods, title, and property in the goods, including full legal and beneficial ownership, shall not pass to the buyer until the seller has received in cash or cleared funds payment in full for all goods delivered to the buyer under this and all other contracts between the seller and the buyer for which payment of the full price of the goods thereunder has not been paid. Payment of the full price of the goods shall include the amount of any interest or other sum payable under the terms of this and all other contracts between the seller and the buyer under which the goods were delivered.
